What’s Really Going On with the Property Seizures in Terralta, Bucerias?

If you’ve been feeling confused, stressed, or just plain in the dark about the property seizure notices posted at the entrances to Terralta and nearby communities, you’re not alone. Thankfully, we now have clarity. The State of Nayarit has confirmed that good faith buyers are not in any danger of losing their homes. The blanket property seizures were not intended to target homeowners, but rather to support an ongoing investigation into the original developer and the government in power at that time. In this post, we’ll break down exactly what’s happening, what the process looks like, and how you can take simple steps to move forward with confidence.
Who’s Affected?
This affects the Terralta Colonia in Bucerías, including:
Terralta 1, 2, and 3
Los Amores 1 and 2
Quadrant
Vista Bucerías
All of these communities were impacted by the blanket seizure notices and are navigating this process together.
Why Were Properties “Seized”?
This all stems from a criminal investigation launched by the State Attorney General’s Office in Nayarit. The target of the investigation is the original developer of the Terralta communities: Dynamica Desarrollos Sustentables.
In Mexico, when someone is under investigation for serious financial crimes, the government may seize property or assets they believe were obtained through illegal means. These are called “Proceeds of Crime.” It could be anything from a car to a bank account or, in this case, homes if they’re still tied to the developer.
What Does the Seizure Actually Mean?
Here’s what’s important to understand:
The seizure is blanket coverage, meaning all homes in the area were flagged while investigators figure out which properties (if any) still legally belong to Dynamica
This does not mean they’re trying to take homes away from good-faith buyers
During this process, no sales or major renovations can take place, but you can still live in your home, maintain it, and rent it to guests or long-term tenants
Renting your property is fully allowed during this period as it does not interfere with ownership or the investigation
The government is simply pressing pause while it sorts through outdated records. In the meantime, daily life and vacation rentals can continue.
Who Oversees the Process?
In Nayarit, when properties are seized, a government agency called COBADAEN steps in to oversee them. This stands for Coordinación de Bienes Asegurados, Decomisados o Abandonados del Estado de Nayarit. Their role is to manage seized or abandoned properties during an investigation.
This includes supervising public areas and ensuring maintenance dues are collected while everything is being sorted out.
On July 19th, 2025, COBADAEN officially began overseeing the Terralta communities, including T1, T2, T3, Los Amores, Quadrant, and Vista Bucerías. They’ve since offered each HOA the option to retain control of their day-to-day operations as long as they agree to send bimonthly reports for oversight.
If an HOA refuses or doesn’t respond, COBADAEN can notify a judge and take over administration temporarily.
What Can Homeowners Do?
After a meeting with state officials, HOA reps, legal advisors, and developers from nearby communities, a process was created to help individual homeowners get their homes released from the seizure list.
Here’s how:
Go to the Women’s Justice Center in Bucerías
Bring your original deed or certified copy, a copy of your deed and official ID (They don't keep your deed. They just want to see it.)
Fill out a sworn statement declaring:
You are the legal owner
You purchased in good faith
You are not aware of any criminal activity
That’s it. No fee. No lawyer needed.
These victim statements are being submitted in daily batches and used to clear homes one by one. Some releases have already happened.
What About the Rumors and Theories?
Since the first signs went up, some people have speculated that this is part of a larger plan to confiscate properties or target foreign owners. Others have shared theories that the state can simply take homes from innocent people, no questions asked. To be fair, these theories took root because of a lack of clear communication from government officials early on. The sudden appearance of seizure notices, without explanation or outreach, naturally led to confusion, anxiety, and space for speculation.
But now that we’ve had direct meetings with authorities, including President Héctor Santana and officials from the Attorney General’s office, the facts are much clearer.
Here’s the reality:
The State of Nayarit cannot legally take a home away from a good faith buyer without due process.
That means:
A judge’s order would be required
There would need to be strong evidence of criminal involvement
The homeowner would be notified and given the chance to defend their rights in court
None of that is happening here.
What is happening is an administrative process to correct outdated public records. In some cases, old records still show the developer as the owner. That’s why the government froze things temporarily and is now asking homeowners to prove they own what they already paid for.
The facts are straightforward:
No good faith homeowner has lost their home
No one is being evicted
Homes are already being cleared and released
While it’s normal to feel concerned during situations like this, it’s also important to recognize that some individuals are using this uncertainty to stoke fear or capitalize on confusion. Whether for attention, profit, or influence, fear-mongering can easily take hold in moments like this.
It’s better to stay grounded, focus on facts, and support one another through the process. The path forward is clear — and homes are being released every day.
